Why You Can't Call The Roberts Court 'Conservative' Any Longer

The MM → Discussion link has worked for me since Day Two. Putting this out there to possibly help TPM/Disco resolve for others: MacOS Sonoma, Firefox and Safari

It means what we assumed… it gives him some cover, but not all.

“Testimony that probes official acts cannot be presented at trial.”

AFAIK, the J6 case doesn’t lean heavily on that, other than demonstrating motive.

I think this refers to the Georgia call.

Trump walks. On all of it. The courts will be forced to litigate unofficial vs official acts, until their eyes bleed. And whatever their rulings, they’ll be appealed, for years and years. So long as official vs unofficial has to be contested, at the pace our courts operate, a President essentially has immunity for everything.

If the Immunity Decision doesn’t wake us up - then I don’t know what will.

So well-timed! He dragged it out so long and now he (and his podcast) will be gone in the last four months leading up to the election. Could hardly have worked out better.

In Thomas’ concurrence, he questions the legitimacy of the Special Counsel.

He threatened Raffensperger on that call.

I have some debate advice for Pres. Biden. Most of the articles treat Mr. Trump’s “Gish Gallop” like it is some kind of unstoppable tactic against which there are no effective countermeasures. Actually, the response is quite simple and you only need to do 3 things: 1. Summarize. ‘My opponent just lied nonstop for 3 minutes. Let me discuss the biggest lie’. 2. Reframe. ‘He effectively said that he wanted to eliminate a woman’s right to choose and prohibit all access to reproductive healthcare.’ 3. Advance. ‘When I am re-elected, I will work with a Dem Congress to make Roe the law of the land!’

This approach forces your opponent to either ignore your points, in which case they go unanswered, or to return to them, thus moving the debate to your terms. Your reframing doesn’t have to be one hundred percent correct: just close. Especially against an opponent who is lying every other word. President Biden doesn’t need policy prep because Mr. Trump doesn’t have any coherent policies or policy knowledge. He just needs to learn (or re-learn) techniques for how to deal with a habitual liar.

There should be a Special Counsel appointed to investigate the corruption of clarence.

Time to stop talking about the debate. The Court is in the bag for autocracy

I’m sure he would find that unconstitutional.

It means that @txlawyer’s prediction was correct and there will be hearings on whether plotting a coup falls within official acts. Outcomes from those hearings will be appealed to SCOTUS again, unless Trump wins and self-pardons.

In informal conversation I shorten the three steps to one: “I stopped listening when you lied about «the first lie in the bunch».”

No self-pardon. trump’s DOJ would dismiss on the merits, just as it did with Mike Flynn.

The SC6 Immunity Ruling summary: Let’s rule that nobody can ever really know if a president is or is not immune from anything. The lack of clarity is totally in Trump’s favor.

The Top Court earned the tag “Kangaroo”
The ruling’s much more than cuckoo
As Trump neared the dock
The Six burned the clock
They’ve effectively joined in The Coup

Kicked the can back to lower courts. Part of the art of SCOTUS wasting their time, but most important, ours. And giving the convicted felon a home free, again.

Does this decision give tRump immunity? You only need to hear tRump’s favorable response to the ruling to appreciate how SCOTUS set up and framed the decision in order to enable endless appeals and delays, no matter how this all shakes out for tRump in the end. So far, this is how I’m understanding this decision.

Official vs. Personal Acts is just a bunch of nonsense dressed up as some kind of special categories. tRump can now assassinate a rival as an official act ffs but its never gonna be ‘personal’ if a president says it was part of their official act.

The Supreme Court is out of control. We really need majorities in Congress to impeach these fuckers. I see no other alternative to these corrupt assholes continuing to make these absurd decisions.
