While the US played a central role in the establishment of the Rome Statute that created the International Criminal Court at the Hague, the US is not a State Party to the Court.

Only two states put the qualifier in their fake certification and are viewed to be safe. NM and Pennsylvania. The other slates of fake electors are vulnerable.
And that’s fine, too. Means that leaks, Trump whining, and media interest is maintained.
I don’t know if you recall how many scandals Trump survived in office because every day there was something new and worse than the one from the day prior, and the media went on to the new shiny thing and old ones faded into nothingberders.
Politically, Trump’s best move right now would be to plead guilty to everything, take some deal that gives him probation, then it would be “old news” and the media would happily just move onto the horse race politics of the campaign.
Congress does not get to set eligibility requirements for the presidency, just like congressional term limits are also unconstitutional.
ETA: Congress can make an individual ineligible as punishment for conviction of impeachment because that’s in the Constitution. It can’t make someone ineligible for jaywalking or whatever.
