We’d be at a point where the DOJ had one year less to gather evidence and flip witnesses, possibly leading to a jury acquitting Trump in the trial for lack of solid evidence of a conspiracy. That’s where we’d be.

Former New York City police commissioner Bernie Kerik is in talks to be interviewed by special counsel Jack Smith’s team investigating efforts to overturn the result of the 2020 presidential election, Kerik’s attorney said Tuesday. Kerik worked with Rudy Giuliani after the election to find evidence of voter fraud and later provided documents about a plan to keep Donald Trump in power to the House Jan. 6 committee. Tim Parlatore, a lawyer who quit Trump’s legal team in May and who now represents Kerik, was asked by Kaitlan Collins on CNN if he expected the former commissioner to receive a letter like the one Trump received informing him that he was a target of Smith’s investigation. Parlatore said Kerik hasn’t received a target letter and does not expect him to at any point. But when asked if Parlatore is “in talks” about Kerik having an interview with the special counsel, the attorney said: “Yeah sure, absolutely. Mr. Kerik has nothing to hide. He’s happy to sit down and explain everything to them.”
Really? You think Jack Smith would have been that sloppy? I guess you’re more informed than me. Anyway, we’ll never know. We’re stuck with the current situation, rapidly butting up against the 2024 election cycle with Trump judges inserted at every level of the judiciary. Fingers crossed.

To be fair, Jack Smith was probably still deep in “Hague-ing” before he could return to take on other asshole world political criminals here in the US.
As a few people have pointed out this was the same charge that the Nixon DOJ civil rights division charged the Trump organization for housing discrimination in 1973. It was of course Roy Cohn who got Fred and Donald to dig in and not admit guilt.

It’s a civil rights-era statute, but there’s nothing obviously about racial discrimination in what Trump did for J6. So the more obvious reading of the statute is that he used his office to obstruct one or more public officials from doing their jobs.
Anyway, here is the statute. Prepare to battle dozens of subclauses.
My guess is that Smith considers his current position to be far more important than his work at the Hague. That work is predicated upon the concept of the US being the beacon of justice around the world. If Trump, et al., are not held accountable, then the standing of the US in the Hague would be diminished. Further, if Trump gets into the White House and successfully executes the power grab that he is telegraphing, we might actually withdraw from the World Court.
It will be a glorious experiment and we only need funding for a computational lab situated in Ibiza.
