You will have to dig up an opinion or two to support that proposition. I was watching those election lawsuits pretty closely, and I don’t recall anything like that being ruled by any judge.

Also, that’s a fairly long way away from the core of the J6 conspiracy. It would be weird as hell to charge Trump with conspiring to fuck up the Electoral College and, in the same case, also that he was kind of racially discriminatory in filing some of his lawsuits.

If your indictment reads like a combination KFC/Taco Bell, you’re not doing your indictment right.

Let’s not forget the armed attack on the Michigan Capitol by insurrectionists which presaged this by a few months. It was done under the guise of opposition to COVID health measures but could have been a dress rehearsal for their fake electors scheme.

I don’t know. I imagine Garland walked into a Department of Justice in total tatters. With whole divisions decimated by firings, folks retiring or simply walking out in disgust and horror. Where Jeff Sessions, of all people, was probably the best leader or only person with any honor at all in four years, which made DOJ the target of Trump’s recriminations early on. And who was it between Sessions and Barr? The toilet guy? And then post Barr–total anarchy for a couple months.

An organization that beat up is not going to be ready to take on a massive project like Jan 6 in a day, month, or year. Garland is a mortal being like all of us, with only 24 hours in the day, much of which had to be dedicated to rebuilding critical infrastructure for a while. Could he have acted sooner? Maybe. But maybe it should be appreciated that he eventually acted at all, given the mess he inherited–probably wishing he’d never left the D.C. Circuit much of the time.
