I just realized that Cannon’s dumb, jurisdiction-less temporary restraining order also neglected to set any amount of security necessary for the TRO to take effect. Security is mandatory for a TRO under FRCP 65(c). The court can waive it, but she didn’t say so and made none of the findings necessary to waive it anyway.

No bond or waiver thereof means the TRO is invalid on its face, even beyond the lack of jurisdiction over the case.

She is so dumb. And sloppy.

I suspect the crimes were about what we have credibly thought they were based on the available information, but that’s REALLY bad so it’s no surprise that he would fight it tooth and nail.

If you knew the way he perpetually played favorites with certain lawyers, that’s a remarkably plausible storyline. Imagine a couple of goofy young attorneys realizing that their gravy train just croaked, so they start cranking out their own orders while propping him up at the bench for one last forced-settlement payday. And he was pretty cadaverous already by the time I had to appear before him.

This is the sort of mess that a good law clerk can help avoid, unseemly as it is for a recent law grad to save a life-tenured appointee from embarrassing her poor self. As I recall, there was some gossip months ago that her clerks had headed for the exits - this gives me the impression that perhaps she hasn’t been able to attract anyone good, or anyone. On the merits, she doesn’t even lay out the factors for issuing a TRO. SAD!

ETA - From time to time I’ve heard of very, very senior judges relying on their law clerks to run interference for them. But this is not that situation.

Jack Smith should simply release it to Hakeem Jeffries, Chuck Schumer and John Thune and then ride off into the sunset. The Congress can then do the public release with no consequence under the Speech and Debate Clause. (I left Mike Johnson out because, well, he is a moron).

Her husband works in the restaurant industry for a guy who made tons of money operating car dealerships and who also – without much proof – was alleged to have been a soldier in the (IIRC) Colombo family four decades ago.
