I think Biden would have plenty of time to deal with that. Except, here’s the thing: presidents and other officials have long had immunity from civil suits over their actions in office, because if they didn’t, everyone who didn’t like anything they did would be suing constantly, it would never end. It was exactly that legitimate need that gave them civil immunity for ages. To see that twisted and turned into a justification for criminal immunity as well was maybe the worst of all the terrible media failures of this century, no reporting I saw ever clarified the distinction and the fact that there was good reason for civil, but absolutely not for criminal, yet they used the legitimate rationale for the one, dishonestly, to seek the other. (And got it, from their hand-raised little brood of monsters on the Court.) So, even without that, Biden would still have been immune from suits. And I too like the idea of the current president/administration using this corrupt ruling for their own purposes. Yet I can also see why they don’t want to touch it.

But this is also in the context of your justifiably popular earlier comment to the effect that Cannon’s ruling is such glaring bullshit and such a non-starter that it can be safely ignored. It’s clearly correct. My only concern really is, can we rely on Garland to just release it on that basis? He’s the AG of the US, I can’t see what would move him not to.

All kinds of court orders are glaring bullshit non-starters, but you still generally have to obey them until you can get them reversed or rescinded. The problem with Cannon’s order is that she has no longer has any jurisdiction to rule in the case, which renders the “order” a nullity. You or I could issue orders in the case with all the same legal effect as hers of this morning.
“Rely” isn’t the word I would use. I expect he’ll let the 11th Circuit straighten it out. There is little reason to think that it won’t. If it doesn’t, we’ll have to see what other steps he takes to carry out his duties under the special counsel regulations.

If they are compelled to delay its release every single time Trump’s lawyers file anything no matter how frivolous… its how trump has been winning for decades.
They care more about so-called rules and norms and are frankly complicit at this point. There is probably some type of kompromat on them as well, embarrassing enough to play the ‘rule and norms’ card for cover.
