Judge (Justice? Chief Justice?) Cannon has ordered all of us to no longer post negative comments about the former reality TV show host, felon, and lifelong criminal and conman on TPM or any other forum.

It may be safely ignored as a proper de jure interpretation, but not in our new de facto reality. I think we are seeing Kellyanne Conway’s, oh so convenient for some, concept of Alternative Facts become our new manifest destiny.

How far down the rabbit hole will America tumble? And/or are we entering into a Trumpian version of a Panglossian world where everything he says or does is good and will lead to good results, pain, suffering, loss and evil in the world notwithstanding?

We had a shitty and malignant federal district court judge named John McBryde for many years. The Fifth Circuit got so sick of his bullshit after a while that they ordered he could not be assigned any new cases for a year.

McBryde sued the Fifth Circuit in D.C. The district court (IIRC) ruled against him, but he appealed up to the D.C. Circuit, which held that as an Article III judge, he couldn’t be barred from doing judge stuff.

The Fifth Circuit tried to take it up to SCOTUS, but the 1-year ban expired and thereby mooted the case.

Anyway, McBryde finally croaked a couple years ago. Still on the bench. Fuck that guy.

ETA: “Still on the bench” at the time he died. But remind me to work up script for a low-budget horror movie. Can’t decide between The Corpse Judge and Corpse Court.

For those of us who had to suffer the indignity of Ken Starr dredging up every real and/or perceived peccadillo of President Bill Clinton, I demand the release of this report on Trump’s real crimes.

The pardon power doesn’t prevent a court from exercising its authority to sanction parties or their counsel for violating a (valid) court order. See Rudy Giuliani.

My point is that the SCOTUS immunity ruling isn’t automatic, all-inclusive, and self-executing. A specific application of executive action like Biden releasing the reports would be challenged in lawsuits by the R’s and Trump’s newly weaponized DOJ. The way the SCOTUS would deal with Biden doing this is also unknown (but we can guess).

It would mean legal expenses and court time Biden would have to deal with next year. So why go through that, if Garland is already planning to release the reports after this Cannon nonsense is dealt with? Garland would pay no price because that’s standard DOJ procedure.

If Garland doesn’t release the reports – and I think he will – then that’s the time to light the torches and demand that Biden jump on that land mine and release them anyway.
