My main concern is the granting of “due process” rights to Trump and his lawyers. There’s nothing in the Constitution about that when it comes to impeachment investigations or proceedings. He gets a trial in the Senate presided over the the Chief Justice of SCOTUS. Anything else is a courtesy and I hope the resolution makes that clear.

Trump will have acolytes in the House asking questions of witnesses. I assume that those same Rs will want to parade a bunch of witnesses out in public to bash Biden and the Ds as corrupt to try to plant a media “both sides” vibe into the public sphere beyond FOX News. So no witness should appear unless the committee votes to have them testify.

Another important aspect of any resolution will be that any refusal of the Trump administration to comply with subpoenas will be considered evidence of both obstruction of Congress and that such documents and truthful testimony would support any articles of impeachment.

Once Trump’s impeachment gets to the Senate, then CJ John Roberts can rule whether certain witnesses Trump wants to call can testify, and whether documents and testimony Trump withheld or prevented he must now comply with. The House also gets due process rights as well to pursue impeachment without the president obstructing it.

Agree. I think she held out until now just to make it clear that she wasn’t going to do something just because the republicans said so, that’s why nothing happened on the return from recess.

But it’s still a good play to make, because basically every “legal” argument has been about that point, so now when she closes that loophole, their continued obstruction will be its own story, as they come up with an even more creative reason not to cooperate.
