I don’t think that’s quite right. Just appealing to the Supreme Court (actually, filing a petition for certiorari) won’t stop the mandate from issuing.

The D. C. Cir. Court’s judgment says:

  • that they will withhold the mandate if Trump files “an application with the Supreme Court for a stay of the mandate.”
  • but only “pending the Supreme Court’s final disposition of the application.”

So, it looks like Trump has to get a stay from the Supreme Court. Which is a bit harder than just filing a petition for certiorari.

Good points. Trump is a clear and present danger to the Republic. SC Smith should ask Judge Chutkan to consider all the threatening calls and emails she has received since she got Trump’s case. She should rule that Trump go straight to the jailhouse after being found guilty as charged to protect the public from his potential incendiary tweets. (You know he will go positively apeshit.) Trump should not be entitled to ANY bail arrangement pending appeal, given his bad attitude.

Judges keep walking up to him, big, strong Judges, with tears in their eyes, telling him: “Sir, you’re totally f’d. We’ve never seen a defendant so f’d.”

Specifically: Four Judges have to agree to hear a case, (grant certiorari), while five votes are required to grant a stay. I’m not sure he’s got five of the Supremes.

From the NY Times:

Steven Cheung, a spokesman for Mr. Trump’s campaign, said the former president “respectfully disagrees” with the decision and would appeal it.

I’m sure Trump disagrees, but I seriously doubt it is “respectfully.”

“If immunity is not granted to a president, every future president who leaves office will be immediately indicted by the opposing party,” Mr. Cheung said.

Am I wrong to read that as a threat?

Sorry to be a downer, but this Supreme Court is corrupt and arrogant enough that they’ll give Dumpy a stay with plenty of delay to have a chance at the White House. If they rule against him, it pretty much guarantees a Biden White House… and nothing is less palatable to the corrupt 6 than a Democrat in the Oval Office.

Judge Chutkan has left her calendar open in April. She has an expensive vacation trip scheduled in August. My guess is she starts trial in late April - immediately after DA Bragg busts his case for fraud in NYC.

As I understand it (if I do), Trump can ask for an en banc hearing, but in 6 days, even if the DC circuit agree to take it, the trial clock starts ticking again. The only sure way to stop the clock now is for him to go to SCOTUS. He’s in a bad spot. The son of a bitch.

Nope, because they’ll only be ruling on an emergency motion to stay, not a certiorari petition. That won’t get filed until later.
