Trump’s lawyers aren’t saying he didn’t do it, just that trying him again in a court of law (rather than the political circus of an impeachment trial) would be double jeopardy.

The types of lawyers that make arguments as stupid as this one are about all you can get when you don’t pay your legal bills. That said, Swalwell should respond with a copy of McConnell’s speech in which he claimed Congress wasn’t the proper forum for justice, that any action against Trump should be carried out in the courts.

Trump’s “absolute immunity” is good for a morning laugh, but mainly I take comfort in the amount of money he’s going to have to spend to fight this lawsuit. And also the way January 6th will keep getting mentioned, while McCarthy and McConnell just want it to go away. I’m not sure Swallwell has any chance at winning this, but it’s going to get dragged out in the courts for a while.
