This is where trump has created an interesting issue for himself. He has done so many illegal things, so much crime, that his and his doj enablers have been pulled into many courts. Many judges.

And when he does something illegal, it can often be considered “related to” something old, and can be fought before the same judge.

So the challenges went to Jessie Furman, who doj already lies too, and furman was then eventually upheld by the Supreme Court.

What are the chances that his equally malicious “we’re going to wrap this all up by the end of September” nonsense gets challenged and before the same judge?

“Isn’t that a problem of the president’s own making?” Furman said, while also pointing out that, had the president announced the policy sooner, then there would not be a need to speed up the litigation.

They will all tender their resignations when the new administration comes in. Not all 350 or so need to be replaced.

Some of the Trump appointees will probably not resign…either Barr will try to shove them into a civil service position or they will just refuse to follow the tradition. It will make a Republican talking point when Biden fires them all…another lie, of course, but they will play it for all its worth. The investigations of the Barr DOJ should follow forthwith however, and make it clear that removing the rot was absolutely necessary.

It would not be at all surprising to see some of these folks try to convert to SES level civil servants.

That’s a flexibility that was built into civil service law in the early 80’s (if memory serves) during a less polarized era. It basically was a common sense measure intended to allow expert career people to elevate into appointee positions and later return to their original jobs without having to resign from government. As government has become more polarized and ideological, this practicality has become harder to preserve from abuse. Some of the Bushies later used this flexibility to burrow themselves into the government structure like ticks.

But didn’t the GOP Congress pass laws early in 2017 making it possible for civil servants to be more readily fired, or demoted with $1 salaries? What’s good for the goose and all…

My guess is high. What I don’t know is if we get a new administration on January 20, 2021, can they re-open the census?

Of course, re-opening the census would be unprecedented and therefore, I’m guessing, need litigating to within an inch of it’s life. Sigh.

It would sure be a lot easier on everyone if the GOP just allowed a normal process (including a rational extension of door knocking because of the pandemic) but they are currently scared out of their wits and unlikely to be rational.

If only our system was that honest these days.

In my view, law only works as law for R’s when they are in power and it benefits them, and against D’s when R’s are out of power, and it is useful. Sort of like budget defecits.

I suspect some states like TX and FL would be very happy to have it redone, so there might be a lot of support to have the census redone in 2021 or ASAP.
The constitution only says that the census has to be done at least once every 10 years, so although I agree with you that they would sue, sue, sue, no reasonable* Supreme Court could say no.
Redistricting also can be done any time–it doesn’t have to be done only on ten years and only after a census. Back in the early 2000s when the Republicans took over Texas government, they wanted to gerrymander the shit out of the state, so they took it to the Supreme Court which said yes, you can redistrict whenever you want. I hope that comes back to bite them now.

*Yes, that’s a flaw in my logic.

I can’t imagine DeSantis doing it in FL. Texas, Abbott maybe, that bonehead Lt. Gov would likely disadvantage the state, like DeSantis just to keep a bad census.

If this is where we get to though, I am guessing the supreme Court will be expanded because of continual GOP shenanigans.
