Kavanaugh cited Bush v. Gore. The citation was notable, given that at the time, the court’s majority said that the decision should not be used as guidance for future cases.

People always miss the implied footnote to that caveat. To wit, *the decision should not be used as guidance for future cases unless the Guardians Of Pandemics are saddled with another dangerous loser and the court has no other avenue to assure that power remains in the hands of a deplorable dystopian minority."

Surprised they haven’t just run out a lawsuit that voting is only legal on election day itself, thus all the early votes have to be thrown out.

So, here’s an irony: The “results” we get on election night are the results of press organizations calling the outcome; official certification happens later. So Trump is… demanding we abide by whoever the media declares to be the winner?

So if the federal courts should not impose themselves on the decisions of states with regard to running elections … how does Roberts rationalize his conservative colleagues who felt it was appropriate to defy the decision of the Pennsylvania Supreme Court and the will of the people?

so… if the Pennsylvania GOP were to bring an emergency case - claiming that there were procedural aspects of their election process that were not put in place by the state legislature - but were illegitimately imposed upon the process either by judges or the governor’s office or some board of elections -
… resulting in catastrophic Election Process “procedural impurities” - necessitating the total invalidation of the results - and the selection of Presidential electors by the GOP state legislature …

would the Supreme Court go along with this utter Bull Shit? would they look at an overwhelming will of the people and discard it on the basis of procedural technicalities ?

We are stunned right now. I can sense it in these posts. But here is the thing:

(1) We outnumber the Republicans

(2) We can outvote them

(3) ALL Mail-in/Absentee ballots should avoid the DeJoy/USPS trap

(4) We have untl this weekend to Early Vote, preferably in-person

(5) We Must outvote the GOP in-person ON Election day

We can and will outvote them.

The question is whether the Barrett Court will respect those votes and let them be counted.

And it’s looking quite grim.

Oh, well, another civil war was bound to happen sometime, maybe this time we can finish the job and not leave it half-done.

And that would be consistent with other governmental agencies, like the IRS or state tax collection offices that say if your payment is postmarked by a certain date, it is accepted as on time and credited. If the post office is running efficiently, there is no reason for an acceptable ballot to be arriving more than a few days later and should definitely be counted.

The Rs will contest the election result, if, as expected, they lose, mainly in state legislatures. They will also have a contest in the courts, but the main purpose of that branch of their overall contest of the election will be to have the courts agree that state legislatures and the Congress, not the courts, are the controlling legal authorities in federal elections.
