A Supreme Court order that backed a Wisconsin voter restriction served as a jumping off point for two President Trump-appointed justices to air a hardcore approach to election disputes. The approach they laid out could prove pivotal in the event of a contested presidential election in which Trump is asking the U.S. Supreme Court to overturn state court decisions that favor his opponent.

Having cocked up the upcoming election, both justices returned to what they are best at. Kavanaugh laid in some delightful 20-year-old Scotch, courtesy of the Federalist Society and Judicial Watch. Gorsuch got back to rehearsing for the part of the most pompous ass in a remake of Advise and Consent, working with his acting coach, Senator John Kennedy (R. LaPuta.)

State Constitution: The right of each individual to vote is inviolate, and no law may abridge it on account of a plague or natural disaster.

State Legislature: All the votes gotta be in by 7 pm on the first Tuesday after the first Monday in November. No exceptions!

State Supreme Court: Actually, that’s unconstitutional as applied in this here pandemic.

Let’s not use language that smokescreens what’s being talked about. These guys aren’t “hardcore”. They’re partisans. Yesterday’s ruling helped the GOP as all restrictions on voting do. There’s a reason only one party is seeking these restrictions and only Judges appointed by that party the ones granting them. You can expect a partisan not hardcore product from this Court.

States with Election-Day ballot deadlines “want to avoid the chaos and suspicions of impropriety that can ensue if thousands of absentee ballots flow in after election day and potentially flip the results of an election,” Kavanaugh wrote. “And those States also want to be able to definitively announce the results of the election on election night, or as soon as possible thereafter.”

Wait, the Original Constitution says that votes counted earlier are worth more than those counted later? That election results must be declared on the day of the election?

There is no rational explanation for holding on to a mail in ballot beyond today !

There will be far too many ballots that just never make it for logistical reasons - but do not have your ballot not make it because YOU never gave it a chance!

But the underlying truth is that if those votes flip an election it should be flipped. If the will of the people is only partially known on Nov. 3 that should not be what is deemed if on Nov. 5 we know differently. If the will of the people is the goal then you allow a reasonable time for the mail to do its thing. If the needs of the GOP is the goal you don’t. You restrict voting and bullshit your way through it.

Trump won in 2016 by less than 80,000 votes in a country of 330,000,000. But he’s acting as that’s sufficient to justify a radical mandate.

As I stated previous I’m against term limits and electing judges outright to seats, but there’s another way for the citizenry to be heard. It’s part of the Missouri way of dealing with judges, we vote to retain or dismiss judges every couple of years. And in the course of voting on judges we the people have access to their written opinions, and their record.
So Kav with his insinuation that if we don’t know the outcome on election night or the next day means that the results are hinky then he’s full of shitty. If the state legislature is the ultimate decider than democracy is doomed. To the gerrymanders goes the spoils of office.
