A Trump-appointed appeals court judge and the House’s top lawyer tangled for several minutes Friday over the idea that court could authorize the Justice Department to release special counsel Robert Mueller’s grand jury materials, but not compel it to.
Please do us a favor, TPM, and humor your subscribers who are lawyers by telling us who the judges are who heard a case. OK, so we got Rao’s name (and picture) up front. We also finally got Griffith’s name, buried way down in the article. But - although I may have missed it - I assume there was a third judge on that three judge panel. Did that judge come with a name? Thanks!
Another of Moscow Mitch’s stealth trump lawyers. He’s stuffed the federal bench with 170 of these incompetent, unqualified morons.
Run for office. Register people to vote. Get to the polls. We are going to need a solid majority in the US Senate to purge America of these dangerous idiots.
The defendant will rise. Having been convicted of first-degree murder, I hereby authorize you to be imprisoned for the rest of your natural life, without parole, although actually this is more in the nature of a suggestion, because I’m not compelling you to do that because non-compulsion is a thing now in juridical decisions. Have a nice day either way.
Not to be soft on Rao, but judges often engage in a line of questioning at variance with how they ultimately vote. In fact, it is their job to ask questions that probe each side’s arguments.
In an October 11, 2019, opinion of a three-judge panel of the United States Court of Appeals for the District of Columbia Circuit, Rao was the dissent in a 2-1 ruling to affirm a district court ruling supporting a congressional subpoena for President Trump’s records from accounting firm Mazars USA LLP.[21] Her opinion stated, “allegations of illegal conduct against the president cannot be investigated by Congress except through impeachment.” [22]
So, you can’t investigate until you impeach. Which is, of course, difficult without investigation.
I ain’t a lawyer, and ain’t a subscriber, but I’d appreciate as well knowing the judges’ and lawyers’ names upfront in the article, so, you know, I could understand what I was reading.
As is not uncommon here, I had to go back and reread it in order to know who was saying what.

Um…what? I can’t get past the first paragraph. Imagine this in the military?
Officer: I order you to fire your weapon at the enemy, soldier.
Private: Sir, you can order me, but cannot compel me. See, it says so right here…I’m going to have to insist on exercising my rights here.
Question for the lawyer types: How is the panel for each appeal selected? Rao, a brand new judge, has been on the panel for two very high-profile cases involving the administration that appointed her. That she is “dancing with the one what brung her” is not a surprise, that she is consistently in a position to dance is a bit suspicious.
I’m right with maricaibo and I’m sure others in saying that this is probably a true example of the caliber of judges that McConnell has been pushing thru the past 3 years. And it underlines the importance of getting tRump out of office. And if anyone mentions the nonsense that votes don’t matter, they’re all the same then here is your answer. Laws can be rescinded, negotiations with other nations restarted but these judges are appointed for life. It will take generations to repair the damage as is.
This just goes back to the basic premise of the Conservative Movement: Reality is a hoax liberals invented to oppress Real Americans, so they should ignore everything we say and just do whatever they want because they’re doing God’s work. If their guy is president, he’s king. If they only control Congress, Congress is all-powerful. If they control states, states are supreme. If they lose power of everything, government itself is a fraud.
That’s why I don’t understand why liberals keep calling them hypocrites and using their bogus arguments against them. They don’t support States Rights. They don’t oppose Big Government. They think whatever power they have is the ultimate power, period. They’re not hypocrites. They believe they should always win always and everything they say leads to that.
Everyone who dismissed my warnings about control of the courts for a generation being at stake as scaremongering and voted Stein or wrote in Bernie is totally okay with Rao being on the second most important court in the land.
