You’d think that after they saw how successful it was to turn off the Epstein surveillance camera and to wipe the Secret Service phones, they would be more thorough with recording devices over which they had 100% unfettered control.

I don’t think that’s quite the way it works. Your read of the false statement provision makes the signature requirement a nullity if an ironclad defense for the signatory could be that they were lied to. As a lawyer myself, I sign things all the time and I know every single time that if I am swearing to something, I need to confirm for myself that the statements I am making are true and accurate based on my own recognizance. Known or should have known is the relevant legal standard; reckless disregard for the law and the truth and one’s professional and personal responsibility is no defense.

That would mean she made the false statement recklessly or negligently, when the mens rea for lying to federal investigators is “knowingly and willingly.”

Her knowing lie was claiming there were no more “responsive” documents at MAL, i.e., documents marked as classified. It didn’t matter whether Trump waved his magic declassification wand over them, as they were still marked classified. And as custodian of those records, she undoubtedly knew.

Ms. Boob needs to get a lawyer pronto, and she needs to withdraw from representing Trump because her carceral interests are now in conflict with his own.

THere’s reason to believe that they issued a subpoena for the video footage on or about the 11th of May. It isn’t clear what period of time the footage covers… but I’d presume it covers the 60 days, prior to that.

Short of simply refusing to hand over the tapes, there was nothing to do… by the time the footage had been subpoenaed, they were screwed. You can’t retro-actively turn off the cameras. I imagine - pure speculation - that Trump’s lawyers explained how secure Merde & Lardo is because of all those cameras.

Really? The buildup to Dobbs had been going on for years. It was not an event in isolation, but the culmination of a series of lesser events. I can’t think of anyone who was surprised by Dobbs.

I just wonder why the hell they left this particular camera (or set of cameras) running when they decided to stash the docs down there. Hubris, most likely. Probably combined with some kind of, “These docs belong to me and I don’t want any of the grubby help getting into them.” But still, when you have full control over the cameras, only a total amateur leaves them running.

Truly, one hates to see it.

I suspect that there are those among us, here in the TPM fora, that are cynical, and have already detected a pattern emerging; Trump and his attorney’s quite often end up it precisely this kind of situation, where their interests begin to sharply diverge. I presume those cynical observers would name Cohen, Ghouliani, Eastman, Bobb, Cochran, and, likely, soon enough, Habba.

So much of the reporting, including here, keeps referring to the documents as “stashed”. That is not correct, they are STOLEN!

Why is everyone having such a frigging hard time with this? Is it because we’re not talking about Hillary Clinton anymore?
