Originally published at: Trump-Appointed Judge In Portland Case: Admin ‘Risks Blurring The Line Between Civil and Military Federal Power’
A federal, Trump-appointed judge granted Portland’s request for temporary protection from imminent National Guard occupation Saturday night. Judge Karin Immergut wrote that some of the Trump administration’s arguments risk disrupting the basic premise that the United States is a country of “Constitutional law, not martial law.” “Defendants have made a range of arguments that, if…
So happy this Trump appointed judge proved me wrong. When the news first broke that the other judge had recused himself and a Trump-appointed judge was put in his place, I was very concerned.
Sadly, it’s not over until John Roberts sings. And lately he has not been doing well.
Ditto. What a relief to find someone in a position of authority who is able to tell the simple truth.
One quibble: “Defendants have made a range of arguments that, if accepted, risk blurring the line between civil and military federal power.” That’s like saying mobsters shouldn’t throw a palooka off a bridge because they will “risk” him contacting the ground.
It’s not a risk. It’s happening, and has been for a while now.
It is time for all our federal judges to follow the same course.
“If the President could equate diversion of federal resources with his inability to execute federal law, then the President could send military troops virtually anywhere at any time,” she said.
That is exactly what he wants to do, but only where the opposing party gathers. And the opposing party is anyone who is against him.
>”She also wrote that President Trump’s own words hurt his case, as his hyperbolic descriptions of Portland as war-ravaged and burning showed that his “determination was simply untethered to the facts.””
More of this, please. Continued and specific pointing out that Trump is making decisions based on some kind of fantasy, delusion – or at best, failure to get good information. At worst – well, we know it’s the worst. Power, inherent hatefulness, and dementia have unleashed his worst and only instincts. The kind of raging id that wiped out the highly advanced civilization on Altair IV.
He’s the exception that proves the rule.
violence elsewhere heightened the risk of violence in Portland specifically.
People who voted Democratic somewhere are a threat to Republicans everywhere.
Just to make clear what the brave ICE warriors are up to. They need to show Stephen Miller how “hard core” they are by beating on old people who are using walkers.
Hard to give that a “like”
Yeah, Immergut’s ruling was well-reasoned and well-worded. One of the best I’ve read.
Portland police checked in on the old couple afterwards. Excerpt from the linked article, my emphasis added:
“They very kindly wanted to make sure I was okay,” Laurie Eckman said. “And they explained that they were not allowed to make verbal contact with the feds and had to stay about a block away. They were very solicitous of me, which I appreciated very much.”
Aha! So here’s one of those ”no go zones” for the cops that we keep hearing about!
Imposed by … um … the Department of Homeland “Security.”
(Do you feel more secure because these yahoos are on the job? Because I sure don’t.)
ETA: I wonder if the Portland officers filed a report.
According to Stephen Miller, this Trump-appointed judge is now engaged in protecting terrorist networks.
Keep it up, Steve. You are definitely persuading the undecided of the righteousness of your cause.
I’ll let you in on a secret: Not all of the 242 (!!) judges that the felon has appointed are actual fascists.
Think about it – do you really think that band of raving loons and incomps got this 100% right? Hell, even Eisenhower made judicial appointments that he later regretted.
She. Judge Immergut is a woman.
“the Eckmans were once active in the anti-war movement . . . [and] they did attend the No Kings rally in Portland this summer.”
Clearly long time, hardcore, anti-American radicals.
Judge rules against you? Then just send California National Guard troops to Portland.
Thanks for saving me the trouble of trying to articulate the same thought.
I dropped off my mail-in ballot in NJ last week.
Voted for every Democrat I could find.
Got a nice postcard from the Gloucester County Board of Elections thanking me for voting early.
Use the drop-box at the town hall, not even trusting the USPS.
Don’t know how it works elsewhere, but as a REGISTERED voter, I get ONE ballot in the mail.
It’s printed on high end, odd sized paper. You can’t just run off copies at staples.
That goes in the green odd-sized, high end envelope with my name, address, and bar code that I sign and put in the yellow odd-sized, high-end postage paid envelope.
These wingnuts act like there are just piles of ballots laying around and you can pick-up as many as you want and send in.
The other fantasy is that you can just wander into multiple polling places and vote as many times as you want. Before CoVid, it was very specific. You had to go to your designated polling place, find your district and sign the book and vote.
I loved seeing that long line of my matching signatures, not having missed an election in 47 years, even odd years as that’s when NJ does gov/lege.
