Supreme Court Won’t Decide Obamacare’s Fate Before The Election | Talking Points Memo

The Supreme Court denied Tuesday a request that it fast-track a review of a Texas lawsuit seeking to dismantle the Affordable Care Act. The rejection the request, made by the legal defenders of the law, means that Obamacare’s fate won’t be decided before the 2020 election, taking political pressure off of President Trump and Republicans.

Yup, who cares if millions with preexisting conditions lose their health insurance. Republicans certainly don’t nor does the Supreme Court.

Anyway. That’s fine. But any democrat, at any level who doesn’t beat Trump and Co. over the head with that lawsuit when he tries to say he ‘saved pre-existing conditions’ needs to be run out of the party. We are running on protecting this law you jelly-spined wimps. This needs to be brought up every single day, even the days when the ACA loses 2 percentage points in popularity in your internal polls.

I actually doubt the SCOTUS is going to kill the ACA, even after the election. They could have easily done that years ago before it became part of American life. It was Roberts who held back and just tinkered to make it worse. They had the votes to just take it all down. They (or maybe more simply, he) are going to be a lot more hesitant about taking away health care that is now being provided than they were before any of it had really gone into effect.

This is all part of the set-up for the upcoming move to mainstream Fascism in America.

If Trump wins in November, they vote 5-4 to overturn ALL of the ACA in early 2021, and blame it all on the Democratic Congress.

The SCOTUS will then proceed to declare unconstitutional, by 5-4 votes, EVERYTHING that is passed and signed into law by the new Democratic President.
We have seen this before: The highly “conservative” SCOTUS opposed everything done by FDR for his first two terms. It was only the onset of WW2 that got them to stop overturning all of his attempts to fix the country.

Head they win, tails we lose.

Now you understand why 2016 was so important, and I hope your vote for Jill Stein/Johnson/other keeps you warm in your prison cell in 2023 if Trump wins again (as he well might) in 2020.

Folks, the decision not to expedite review only assures that it will be a live issue this fall. Donald Trump and his GOP co-conspirators will still be actively trying to kill the ACA. The four liberals can still force the issue by granting the petition for certiorari, which would almost certainly mean the case would be argued in October. And whether or not they grant review, the entire dumb case can be mooted by a new president and senate reinstating a $1 tax penalty.

If John Roberts was aiming to take this off the table for the 2020 election, his only move was to expedite review and vote yet again to uphold the ACA. This decision was not that move.

Correct so put it in ads and mention in stump speeches. The health insurance angle helped the dems get back the house in 2018.

The fix is in so deep - the federal court system is rapidly becoming part and parcel of the Republican hegemony and a safeguard against any pretense at democracy as we go forward. Our only hope is to smash these guys at the polls - anything less is a Pyrrhic victory at best.

Republican position in a nutshell: The ACA is the worst, it’s socialism!!!1!, it provides affordable health care to people who can’t afford it, and we can’t have that.

We want to destroy it…but, um, not right now. Let’s wait until after the elections so Americans don’t realize what we’re up to when they go to the voting booths.
