SCOTUS appears to be actively attempting to k#ll the Preznit via stroke and/or rage-induced heart attack. Even Roberts has noticed the danger to the Republic!

As someone who believes that public opinion shapes the Supreme Court (imagine Obergfell being decided in 2005 v 2015), this decision is consistent with that theory. Legal immigration and DACA are popular, and have become more popular in the Trump era. Trump won the travel ban b/c his DOJ lawyers cast it as a response to ‘terrorism’ from Muslim immigrants and visitors. That issue is more ‘popular’ in a political sense for a Republican.

The other thing playing into the recent decisions is Trump’s declining popularity. Society has coalesced around a set of values that aren’t very Trumpy and there is societal push back against him at every level. The court is nodding to that. At the end of the day courts decide where the line is between governmental action and individual freedom of action. Where the issue is in a grey area they can step on the scale on one side or the other. However, they can’t run too far afield of where public opinion is in order to maintain legitimacy and to avoid a backlash when the opposite party comes into power.

I listened to a story the other night that said if SCOTUS ruled for Trump 27,000 healthcare workers, nurses, doctors, therapists, etc would be immediately subject to deportation proceedings. In the midst of a pandemic.

He understands that if the SCOTUS conservatives continue to rubber stamps Trump’s desires, they will find themselves in the minority come next year, and somebody else might get designated Chief Justice.
