all 50 state constitutions include explicit pro-democracy provisions . . . The flood of election litigation also results in hefty financial costs to state governments . . . hyperlitigation burdens the state court system
The Supreme Court will eliminate those concerns when it rules in Moore v Harper that state constitutions cannot impose on the state legislature’s absolute power over elections and state courts cannot hear election cases.
I went to look up the story in GA that happened last week (?) where a young black woman went to her polling place and was informed that her eligibility to vote was being challenged. She was offered a provisional ballot. She didn’t know who had challenged her eligibility, and didn’t trust that her provisional ballot would be counted.
So it’s more complicated than one would think. And part of the confusion is that GA state elections director sent out a poorly memo on how challenged voters should be handled at the polls. He had to send out a clarifying memo.
This is the type of voter suppression that is going to cause the most harm. The problem being new rules, procedures that haven’t been tested, and lack of transparency. I can’t imagine showing up to a polling place to vote and being told that my voter registration has been challenged.
In GA a person can challenge an unlimited number of registered voters. And it may be something as stupid as not putting one’s apt # after the address.
No they’re fascists, not anarchists and they do have a plan. Here’s what Bannon said in that NYT article:
On his “War Room” podcast, Mr. Bannon tells listeners that Democrats will win elections only if they steal them. He and his allies can prevent that “by taking over the election apparatus,” he said on his show this month.
The fascist method isn’t to destroy the electoral system, it’s to control the system, so only their side wins under the false guise of a free election. Like the way Putin was “elected” to a fourth Presidential term. The anarchist approach doesn’t involve that fig leaf of respectability.
Someone like Musk looks at his empire and still realizes he can’t control how people think, or stifle the stuff he doesn’t like to hear. On Day 1 you see why he wanted it.
I think Musk, like so many of the oligarchs, is a sadist. He’s already arguing that the Twitter execs he canned aren’t eligible for their golden parachutes because he’s firing them for cause. And he’s canning lots of the ordinary shlubs by Monday because they will vest for stock on Tuesday (Nov. 1.) Just a malevolent, greedy, asshole.
Good article, but I’m surprised it doesn’t include anything about the republican push for the “independent legislature” to prevent state courts from making the legislature follow the state constitution.
I don’t think people realize how easy it is to get info from smartphones, even without hacking. Combine that with an older, technologically behind generation holding the levers of power and you end up with an entire political party held down by kompromat.
Yes I live on billionaire’s row and need a male prostitute. Please get me a homeless, unwashed, dirtbag, Qanon spewing, Pelosi hating nutjob living in a storage unit please…
