Hay should be made of just what the pro forma sessions are for – allows them to check in for an hour or so in order to keep the per diem payments coming. It’s a long-standing ruse that keeps taxpayer dollars flowing to members who have no intention of doing any of the business.

That’s the key. During a pro forma session, yes. But Mitch McConnell could call a special session, I believe. Of course the reason he has pro forma sessions goes back to 2018 when Trump was going to use the times when they were in recess to make recess appointments.
That lasted until this year, when Trump threatened to just adjourn them himself.
