Lawyers here may be able to clarify: Would Flynn’s son be open to prosecution by another AG and justice dept, say next year? It certainly sounds like they had evidence.

Yes. To the extent that Flynn did not cooperate, and sought to undermine his plea, he has voided the agreement by non-cooperation. Absent something really unusual, the plea will say that the benifits to Flynn (which include non-prosecution of his son) go away if he does not cooperate.

I believe the statute of limitations is 5 years, so DOJ can being charges against Flynn’s son unless he is pardoned.

And I might add, DOJ could challenge Flynn’s pardon. They would argue that Trump did it for corrupt reasons and as part of a conspiracy to get him not to cooperate with Mueller.

Funny, I was watching the movie, Molly’s Game, the other day.

During her guilty plea, Molly Bloom was asked something like 80 questions to ascertain that she was of sound mind, that she fully understood the charges, and that she really, really, really, meant to enter a plea of guilty.

My question is: where’s the transcript for Flynn’s appearance when he pled guilty. How many times was he asked if he really, really meant it, that he understood the charges, and that he really, really meant it (both times!). Let’s see it, TPM!

Both the DoJ and Flynn’s whining see to boil down to the judiciary can only do what we tell’em as long as we like their decision… if we don’t like then the they’re stepping outside what we consider their subservient role in government

Would depend upon the wording of the original deal with Mueller. And its quite (highly?) possible that no such agreement was ever put into writing.

My own personal opinion is the deal he did strike with Mueller was a crap deal anyway. His “cooperation” was meaningless, if it ever existed. He pleaded guilty to lying to the FBI on multiple issues, which can carry a 5 year penalty per incident, and working as an unregistered foreign agent for Turkey, which also carries a 5 year sentence and up to a $10,000 fine (similar fines can also be levied for lying to the FBI). So he was looking at 10 years + an additional 5 for each separate incident of lying.

Instead, he got no fines, and a 0-6 month recommended sentence. For providing nothing of use to the Mueller investigation, and then he voluntarily rejected his own guilty plea and started this mess.

So yeah, I think a new AG would have quite a bit of latitude to prosecute Flynn and his son, and throw the freaking book at them both. Bury this asshole and his spawn so deep into jail they we have trouble finding their rotting corpses in 100 years.
