They’re pretty well fucked. There is clearly constitutional “malice” here, i.e., they made their statements about these companies with knowledge that they were false or with reckless indifference to their truth or falsity. Their best defense strategy would probably be to get the plaintiffs ruled to be public figures, which would require them to prove actual damages instead of just letting the jury award whatever it wants, as juries often get to do with private figure plaintiffs. But even then, I presume that these plaintiffs have deep enough pockets to engage some experts to work up a damage model.
So yeah, Fox and Newsmax are scrambling now because their lawyers have told them they really shit the bed on this. OANN might just be crazy enough not to follow suit.
Yet said claims were reported nevertheless. I don’t recall any disclaimers like “the following report is not true, but we’ll report it anyway.”

I’m not suggesting this actually happened, but the strange change in trends across so many counties is a lot more suspicious than anything Trump has brought up. And the same machines got used in Graham’s and Collins’ races that they won FAR more easily than anyone could have expected from polling (Collins hadn’t lead in a single poll since July). Proof of nothing, but more worth considering than anything in the Kraken.
