Legal Experts Slam Judge’s Approval Of Trump’s Special Master Request

Legal experts were left reeling on Monday after a judge approved ex-President Donald Trump’s request for a special master to review the documents the FBI seized from Mar-a-Lago as Trump insists the materials are covered by executive privilege (actual sitting President Joe Biden has not claimed executive privilege over them).

I sincerely don’t know why anyone is surprised by this ruling. By all reports, this judge had no business being assigned or referred to the case. And that’s exactly what TFG’s legal team hoped for. She has put the brakes on the review of the documents and it could be months before the review can continue.

You know all that excitement we felt with the FBI search of ML? No more.

DOJ is presumably examining the documents for evidence (i.e., fingerprints) of the persons who’ve had access to them. This order seems to stop that. Ridiculous, since the classified documents are well outside any claim of attorney-client or even executive privilege.

I suggest that the FBI search Bedminster, Trump Tower and other Trump properties to look for the seemingly missing documents from the folders marked “classified.” That will give DOJ something to do while this dumb order has halted the examination of the Mar-a-Loco documents.

I guess there “Obama judges” and “Trump judges.” Or maybe real judges and fake judges.

I think it’s just shock that any judge would do something so brazenly unsustainable. They usually have some vestigial sense of shame, even if they’re appointed by TFG.

11th circuit appellate court appointees:

1 bush (the lesser)
1 clinton
3 obama
6 tfg

Any questions?

The Judge enjoined the investigation of the fruits of the search - not the criminal investigation. If the DoJ wants to press ahead aggressively, they should subpeona everyone around Trump including his dime store counsels, Meadows, Patel, and even THIS JUDGE WRT Obstruction.

This truly is the second Judicial-WTF-Moment in a week: First, one judge bails Trump’s loiyas out by extending the date to file(respond);they missed last week’s deadline- now THIS shit, literally writing Trump’s argument then affirming his (her) position.
I cannot imagine the Gov not immediately appealing.

Well, apparently DOJ is still allowed to review the docs for assessing damage to national security. Not sure how the court can oversee what the DOJ is doing with the docs. And part of the assessment of damage has to do with what to do with the idiot who broke these laws. Whether or not he still has more docs, whether or not he burned them, etc.

How would they even separate the two?

Biden is president until at least noon on January 20th, 2025. Merrick Garland isn’t going anywhere either. We can wait a week or two for this to take place.

This was a pure delay tactic. Will they find a special master with the high clearance needed to go through all the documents? The have until Friday to find one.
DOJ should appeal and quickly ! There is no such thing as executive privilege to a private citizen.

Here’s a question: Why should we assume every Trump-appointed judge would side with him?

Plenty of Trump-appointed judges have sided against him since November, 2020.

Or, should I say, sided WITH justice.

Everybody’s got it wrong. When Drumpf said he wanted a “special master,” this is what he had in mind:

They are right. Judge Cannon is wrong. Trump really lucked out in his forum shopping by getting the case assigned to her. But the only damage is in delay, and a very squishy precedent.

Now it’s up to which 3 judges are on the 11th circuit panel, if DOJ appeals. Again, luck of the draw comes into play.

Making it apparent the vast difference between being a legal expert and being Judge Cannon.

This isn’t an article. If I wanted to read tweets by legal experts I’d go to twitter.
I expect analysis in a news article, not unconnected quotations.
This isn’t journalism.

Luck had nothing to do with this. This is another facet of the “vast right wing conspiracy” the Clinton’s warned us about. A Federalist Society judge protecting a traitorous criminal ReThug.

Six Federalist Society judges on the 11th Circuit and the SCOTUS -ALL ReThugs !!

Biden has these people pegged and he needs to ask AG Garland to initiate the necessary actions to legally remove every one of these bastards from the Federal Bench for manifest corruption.

There is analysis in the article. Analysis by legal experts who posted their analyses on Twitter. This piece collects some of them for us. It’s a useful service.

Nominated for dumbest take of the week, and it’s only Monday.

But your latest attempt to blame democrats for the bad actions of republicans is noted.

They’ve already finished the review of documents. That’s one of the many reasons why this decision is so ridiculous.

but now her “bona fides” as a bought-and-paid-for representative of justice in Florida are now solidly in place. Even on reversal, she can always claim she did the (far) right thing.

But with this decision, will any of the completed review be pertinent and move forward with the next steps? It appears any forward movement is blocked for the time being, no?
