This strikes me as a loser’s strategy. What I mean by that is that the court clearly believes that it is not going to win in this process. It believes that it will not succeed in getting the Trump administration to follow its orders. This is why it’s strategy is to document everything to Trump administration is doing to the greatest extent possible, rather than actually doing anything to facilitate Garcia’s release.

This may be the best strategy, because the more active court might end up spending more time waiting for appeals, but it suggests that already people are planning for a future where the rule of law is upheld, rather than a present where the rule of law is respected.

This is the part that seems like it ought to get widely reported. If he made it to the border, they’d do it all again. How much more do we need to confirm their middle finger to the judicial branch?

I know this is a petty thing but I think I’ve figured out what the Rump is doing when not spewing nonsense or waving sharpies around. I think he’s redecorating the White House in his favorite hoarder style. The Oval Office now looks like he’s been going to estate sales down in Palm Beach and picking up the ugliest gold painted trash he can find. And where has Melania been disappeared to? Is she supervising her weirdo kid at college from the NY apt. or has she been sent back to Slovenia or is she just living at Mar a Lago with a pool boy?

My gut suggests she just ordered up the beginnings of a massive anal probe of the administration.

The Judge needs to issue contempt citations and jailing people. This is bullshit- Trump and his goons are betting the Judge won’t do anything. Lord knows Congress won’t.

Of course DHS would take him into custody and would do so legally. But they could not legally deport him without his having his due-process day in court. They might try that, but they’d be in big big trouble with the court.

If this Judge is going to end up sanctioning the administration for its bad acts then she needs to come up with an out-of-the box unprecedented punishment that is designed to reform the behavior and get their attention at the same time.

Perhaps instead of an off the shelf sanction that imposes a fine or jails a designated victim… She can decree that this administration is not trustworthy and as such there are limits to its ability to contract. Perhaps decree that any contract greater than 10,000 must be co-signed by a civil servant with at least 12 years seniority (termination exempt) or by a district court judge. Where failure to follow her instructions would result in a completely viodable contract not enforceable by any court.

This could cause a serious loss of face for Trump and all of his billionaire buddies They would no longer be able to treat their department like their own little fiefdom and would have to KowTow to a ‘minder’.

As an extra benefit… it imposes a punishment that Trump can’t pardon.
