WASHINGTON, DC–Federal District Court Judge Richard Leon expressed shock Tuesday that the Trump Justice Department was asking him to break new First Amendment ground, the better to punish Sen. Mark Kelly (D-AZ) for speaking out against the administration. “You’re asking me to do something that the Supreme Court has never done — that’s a bit…

“Secretary Hegseth censured me and is now trying to demote me for things that I said and for doing my job as a United States senator,” he said as a cement mixer truck loudly rumbled by.

If we can’t take away your First Amendment free speech rights, we’ll drown out your voice.

The regime won’t prevail in court. But it will very successfully take up a lot of Senator Kelly’s time and attention, and cost him innumerable bucks by dragging him back, again and again, with these frivolous allegations that, in a sane legal system, would be thrown out upon receipt.

Instead, the charade of a “trial” must take place, and subsequent delays, new interjections from the prosecuting attorneys for the regime, and retrials. The hammer will continue to hang over Sen. Kelly’s head, potentially for years.

Surely, in the 21st century, with telecommunications, computer data storage and retrieval, and even (glarp) LLM/AI, crap like this and every other case can be more quickly sorted, culled if appropriate, and even adjudicated?? Without causing actual victims or the accused losing their rights?

No, they won’t succeed at this level, nor possibly at the appellate level.

All bets are off if it gets to SCOTUS.

Is there a single lawyer left at DOJ who’s willing to go into court at Bondi’s direction who is capable of making a coherent legal argument? I’m beginning to wonder if everyone who’s left is both competent and willing to sell his or her soul.

I was reading an article about how many lawyers have left the DOJ and wondered the same thing.

This is a nothing case. I don’t think Hegseth stands a chance. I think Bondi is banking on getting somewhere with the Don Lemon case.

I do not understand why the Trump Administration is still taking Sen. / Capt. Kelly on. They are making him a hero, AGAIN ! The Administration can’t win this.

Sen. Kelly has the First Amendment, the Speech and Debate Clause and the fact that he was simply restating the existing LAW behind his speech and his position. As a member of Congress, he has the right to advise service members on their Oath to the Constitution.

Also I don’t think this is costing Sen. Kelly much - the funds he is raising off this will pay for any legal expenses as well as many of the best civil rights lawyers are working this issue on a pro bono basis because they know the stakes.

All this bullshit just shows how pathetically stupid and weak this DoJ is. Show me ONE example of a verdict or motion they have won on the merits. I can’t think of one. These people are all losers.

Defense Secretary Pete Hegseth trained his fire on Kelly after the senator appeared in a video with other members of Congress advising members of the military that they cannot follow illegal orders.

Pete’s been drinking again.

Did he not see the part of the video where Senator Kelly also urged the military to brush after every meal?

Noooo, oversight is the sole purview of Republicans over and against Democrats/Liberals.
