What asking her formally to recuse herself?
At what point would the record show that she should do so, such that a.higher court could rule that she should?

I think Judge Cannon has far too many means at her disposal to ensure acquittal at trial – jury selection, evidentiary rulings, and – especially – the jury charge. If, for instance, she instructs the jury that the Presidential Records Act authorizes a former president to retain presidential records after the end of his presidency so they can be sorted from personal records, the acquittal will be swift and non-appealable.

It’s long past time when the entire issue of recusing her from overseeing this trial should have been raised to the 11th Circuit. Smith has generally been on his toes about making the right move at the right time; maybe he’s just been waiting to make sure she has already been given more than enough rope to remove any doubt. Any move on her part to delay the trial even more would seem to meet that criterion, and then some. And should the 11th see fit to recommend her removal from the Bench entirely, that would only be her just desserts. IANAL, of course, but as a reasonable person, that would seem to be a reasonable response.

She’s not being manipulated. She’s been given marching orders from someone else. She’s doing THEIR bidding whoever it is. Vlad, a Saudi prince, Leonard Leo or some other Conservative paymaster.

She’s in over her sneakertops. This case is way more complex than she’s prepared to handle. She is predisposed to favor the defendant, but knows that she’s being closely watched by lots of people.
In short, Her Honor is not having a good time.
And the way she responds to that is apparently to lash out and be nasty to the prosecuting side, because they persist in holding her to standards and making her look bad.
People’s true character is revealed when they’re under pressure.

She has a chip on her shoulder that conveys her deep insecurity. It is well-deserved, since she has never presided at a non-trivial trial before and is in way over her head.

Well he did give her a public promise to appoint her to the Supreme Court.

Handled atrociously, of course, but the point of the Garcia proceeding is to make the conflict clear to the client and to obtain a binding waiver of it on appeal after conviction. As sloppy as she was, that purpose has been accomplished.
I don’t think she’s champing at the bit to get there. If everything else went away and trump went to trial facing real criminal jeopardy in the documents case, I am confident she would do her best to tank it. But I am also certain that she is aiming to delay it until after the election in hopes that it goes away.
