The Justice Department scored a temporary win Monday in its fight to keep secret parts of a key memo concerning the Mueller investigation. But that victory came with another blistering order from a federal judge, who has accused the department of misleading her in the litigation over the memo’s release.

I understand. Judge ABJ making sure that her decisions stand on appeal. IMO, DOJ reluctance to release memos and legal reasoning indicates a weak legal position held by the OLC. Too much ratfockery within DOJ still. Couldn’t we send the OLC on a cruise, and throw them a free fantail party? OT: Did Garland have his meeting with the surveilled news networks today?

Why doesn’t DOJ just release the letter? Or do they need to remember that what the OLC declares IS NOT LAW, it is OPINION. Got that?

There’s a lot to be said for continuity. It’s good to see Biden’s DOJ is still working for Trump. Protecting the Mueller secrecy. Paying for his rape based litigations.

This stonewalling on the part of the Biden/Garland DOJ infuriates me. I can see no good reason for it and they sure haven’t convinced ABJ that they have one.

My assumption of good faith on their part is being sorely tested.

And ETA: If she hadn’t stayed her order, the appellate court almost certainly would have, because failing to do so would make the appeal moot.

We’re going to have a difficult time in the future attracting Presidential candidates this nation deserves if we insist on them obeying our laws, and threatening them with prosecution for breaking them.

If this delay isn’t for the purposes of protecting an ongoing investigation, it’s unconscionable.

Power protects Power. They aren’t protecting Barr/Trump, they are preserving that power for themselves. They likely also think that if they act on behalf of the department they will be protected when the next admin comes in. Too many Democrats think Republicans can be trusted.

As of tonight, the good guys will hold a 7-4 majority on that Court of Appeals, and that en banc majority has shown no tolerance for Trumpist hackery by Rao and her ilk. Meanwhile, John Roberts could barely lift a finger to help out Trump while he was still in office. He’ll be in no mood to do so over a memo that DOJ is free to reconsider and release anytime it wants.
