Felony generally means punishable by a year or more in jail, and a misdemeanor is less than a year. But the judge doesn’t have to sentence the person to jail in many cases, even in a felony matter. Georgia’s RICO statute does have mandatory jail sentences, which is why they’re not pleading guilty to RICO violations.
Cheseboro copped to a felony charge but will not do prison time. I believe there is a first time offender provision in GA law for certain offenses that allows this non-prison sentence if the DA is so inclined.
