“It’s not a criminal trial. The Senate is not really a jury,” Kennedy told CNN’s “State of the Union” host Jake Tapper. “It’s both jury and judge.”

So it’s a jury and judge…and it’s okay to coordinate with the defendant? What a waste of a top-notch education.

We are judge and jury and therefore we don’t need to even pretend to impartial. Who would want to stand before a judge or jury that wasn’t willing to declare their verdict before the trial?

GOP logic is great. It doesn’t matter that it is direct contradiction of the oath by any measure. It doesn’t matter that the “defense” he offers just makes it worse. As long as he is on the TV and making noise it’s a positive for their side. And there seems to be a solid 40% of the country that laps it right up.

But what it really comes down to is this: it’s only a crime if we can accuse Democrats of doing it. Otherwise, IOKIYAR.

Ditto for whether something is impeachable or not. Consensual sex in the Oval Office - definitely impeachable. Selling out the country to Russia? Just a business deal.

Not a jury. Just a group of people who vote on whether to acquit or convict an accused person.

Reminds me of Calvin Trillin’s careful distinction between pizza and focaccia, a distinction I believe he said was “mostly in the spelling.”

This is the Oath Senators are required to take prior to an Impeachment trial. An Oath, under God, one would presume. An oath that Senator Kennedy has made clear he will violate. As such, he needs to recuse himself.

Unwittingly, of course, he’s raising alarm bells as to why exactly he can’t allow for impartial justice to guide the process. In other words, why Republicans need to put not their fingers, but both hands on the scale to protect Trump and prevent him from facing justice.

Would Senator Kennedy like it better if we called it a tribunal or court of inquiry? So whatever we call it, it doesn’t negate the fact that Senators have to swear an oath.

Powerful white guys been immune from the law for generations, centuries actually, just can’t get in the mindset of following the law. Why start now? Those white male judges appointed by the criminal on trial going to set you all free.
