Florida Judge Says DeSantis’ Congressional Map Is Unconstitutional

A state judge in Florida on Wednesday said that a gerrymandered congressional map pushed by Florida Gov. Ron DeSantis (R) was unconstitutional because it diminished the the ability of thousands of Black voters to pick the representative of their choice.

There is no doubt DeSantis will be our next president. I base this on my personal observation that every Republican since Nixon who has presidential aspirations and turns my stomach to a degree where I am almost physically ill (think Reagan, George W, Trump) has eventually won the presidency.

When it gets to the Supreme Court they will pronounce it to be a political gerrymander that is beyond the reach of the federal courts.

Well, this is going to be a challenge for the Supremes. Assuming the Florida courts reject DeSantis’ appeals, the decision will then make its way into the federal courts, eventually arriving at the Supreme Court. The Supremes have frequently deferred to state court interpretations of their own constitutions. But this one seems to favor the Dems (given how bold and aggressive was the Governor’s). What to do? :Leave it to Alito, I would think, to posit that the Constitution says nothing about gerrymandering, so – there you have it.

Smith said, he was leaning toward using an alternative map proposal known as “Plan A” as a remedy. The map was recommended by an expert witness for legal challengers against DeSantis’ map, Stephen Ansolabehere of Harvard University.
