Prosecutors have to have proven to a federal judge by a preponderance of the evidence – i.e., more likely than not – that the phone contains evidence of a federal crime.

Would they know for sure up front whether he was still using the same phone as he had been previously? Or would the search warrant generally cover some group of devices, including whatever he was actively using now?

It is quite probable that they hit his provider with a no-notice search warrant some time ago, which probably means they knew what devices he’s been using.

I have updated cell phones quite a few times since easy transfer became the norm. Even before that, my accounts at a number of web sites save a lot of my past history - and simply linking to the sites from my new phone connects my new phone via login to the old accounts.
