The leaked draft opinion that set America aflame Monday night contains more than proof that a majority of Supreme Court justices voted to overturn abortion rights. It’s peppered with hints revealing an openness to outlawing abortion nationwide, always the end game for the core of the anti-abortion movement.

I fear that this is a correct assessment. At the same time, I believe that if Gorsuch and Kavanaugh vote to end Roe v Wade, they are guilty of perjury. Both, during their confirmation hearing declared their fealty and support for court precedents, they did so under oath. In this case, they should be impeached and indicted.

Why aren’t defenders of our rights not using the argument that this is an attempt to impose theocracy, in this case an illiberal religious binary of human life vs. non-human life, with human life beginning at conception? In fact, following that theocratic logic would leave us with funerals for miscarriages, which are in the early stages very common and even in principle when embryos are not implanted. Of course, no one really does. Many embryos pass unobserved and unnoticed into oblivion.
Imposition of that regime is why they’re disingenuous in their arguments and why they’ll absolutely go after LGBT rights next and then of course non-marital straight sex.
No one should treat this as a single event. It’s just the beginning of a multi-prong attack on all things offensive to religious extremists. They have their Court and NOTHING is going to stop their holier than thou motives. Not the Constitution…or the will of the people. Step one was today. Step two is soon to come as is 3 and 4 and so forth. What can stop them?
They are not guilty of perjury, at least not based on what they said in their confirmation hearings. All they said was platitudes about “law of the land” and “settled law” or that they’d keep an open mind. They didn’t promise not to overturn anything, and you’ll never be able to prove they were lying about the platitudes.
People argue, he writes, that fetuses shouldn’t get legal protection until they amass the necessary characteristics to count as a person, naming “sentience, self awareness, the ability to reason.”
So if Alito wants to make every fertilized egg a person will do the laws also apply to newly created person? If the pregnancy is fatal to the woman who is carrying the newly created person will the infant be charged with manslaughter? ( a bit of irony there don’t you think)
Would every fertilized egg that doesn’t implant be considered a person? And how would be count these, or make the carrier responsible for losing the fertilized egg?
At what point can the carrier get a SSN for the fertilized egg? Get a child tax credit?
How about a fertilized egg gets to be called a person when they can live outside their host?
Good question. No one knows when life begins, what a soul is, if anyone has one, or if there is a God. But instead of people minding their own business, we are being governed by people who believe those things, without any evidence of anything. I guess politicians don’t want to offend religious people who are not extremists?
This is the hand we are dealt. If we all vote like we are capable of doing we could have several seats picked up at least in the Senate and solid majorities in the House.
The alternative?
