I donā€™t have much hope that the corrupted SCOTUS wonā€™t find a way to let the Idaho abortion ban go into full effect, but they will have to twist themselves into hideous pretzels to do so. Each time they do, it will make them more unpopular until it forces the American people to accept expanding the Court as the least worst option.

In the meantime, good work AG Garland.

Thereā€™s much cynicism in this fight, and many who want to sit on their hands and say that whatever we do the supreme Court will just override it. This of course is intentional. This is how the supreme court and federalist society want us to feel. They want us to feel powerless, so that we donā€™t take collective action.

We are not powerless. Our federal government is taking whatever action it can take within what laws it does have. We are actively seeking to campaign, and to encourage people to campaign on this issue. We will win, because in the end we are right and there are more of us.

Personally, I believe these types of laws should have three exceptions:

  1. For the health of the mother

  2. For rape or incest

  3. For whatever the hell reason a woman chooses without some mansplaining jackass with a Y-chromosome or an ā€œRā€ behind their name having a G-ddamn thing to say about it

It will be interesting to watch the Supreme Court rule that the federal government canā€™t protect people who go to emergency rooms, ensuring that emergency rooms refuse to treat some people (for whatever reason) and some end up dying outside the hospital. Sure will show how ā€œpro-lifeā€ they really are.

Thanks to clinics close to the state lines in Washington, Oregon, and Montana, it doesnā€™t look like very many people in Idaho in need of abortion services are going to have to drive more than a couple hours to get an abortion. And most of the people with longer drives probably would have already had to drive a couple hours to get to an in-state abortion provider.

So basically the Idaho ban is just dumb posturing by the very bad Idaho legislature.

But unless they pull it completely out of line with some Shadow Docket crap, they donā€™t get a say until it works up the chain of the district and Appeals courts. So it would depend on what sort of injunctions the lower courts impose in the meantime.
