I’m wondering whether DOJ will be cancelling its opioid lawsuits against Walgreens and CVS. The big chains are going with the “vague regulations of an over reaching executive agency, that aren’t supported by statute” defense and Republicans are locked and loaded to believe this shit in every other context.
DEA regulations really are vague by the way. I’m not asking to admit that conservatives may have a point, but pharmacists’ “corresponding duty” to make sure prescriptions are legitimate, is really no clearer than that.

The fucking irony. They hate DEI because they believe it puts some ideology above actual qualifications. So they cut contracts because the company’s have a DEI program someplace in their mission regardless of their actual performance. So, White Guy Jim who’s cousin has a buddy in the DOGE world will get favored treatment over an actual qualified company because he is anti-DEI and has a connection. Cool.

Josh makes an astute point. The US is the Largest recipient of foreign direct investment in the world.
Now imagine that that money decides to leave, or simply stops flowing in. China’s FDI inflows have also been declining.
Federal contracts typically have cancellation clauses that require the government to recompense the contractor if the contract is cancelled for anything other than non-performance or poor performance. In fact, I know of a contract that had received a “Cost to Terminate” letter due to the government’s dissatisfaction of their work. The government was formally asking how much it would cost to close the contract under the contracts terms and conditions (T&C). So simply canceling contracts willy-nilly with no cost to the government is far from normal.
I have no idea what kind of claims can be brought for cancellation on the basis of a change in political “philosophy,” but these people were acting in good faith on contracts that required DEI at the time.
I’m sure law firms that specialize in Federal contract law have a large number of lawyers, each with specialties in specific aspects of that law, and I doubt that any of those firms would stand up and say they unequivocally know all of it. I wonder how many are digging through the FAR, and licking their chops at the prospect of awards.

So does this mean that MAGA now thinks it would be okay if the next administration decides to cancel any federal companies, regardless of performance, based solely on a company NOT having a public DEI policy?
Not too long ago, conservatives railed against “unelected bureaucrats in black robes”, but if you’re a billionaire in a black cap calling the shots, I guess that’s OK.
It sends a message that if contractors want to conduct business with the federal government, they cannot engage in anything that DOGE deems “DEI”
This is Phase 1 of the purge. There’s one coming for all of us.

Next, Phase 2 will continue the process by targeting the truly loyal, by identifying those who agree but will not comply, who will not submit themselves to state-sponsored lawlessness.
The fact that “the law” is completely ambiguous – being made, judged, and executed by one politician – is the fun part. For them. For us, it proves this movement is not out to create an Eden on Earth, not even a paradise of white people.
No, the goal is to benefit a select few with only and all the resources they need for their own ultra comfortable, completely secure and protected brands.
$10 says some, if not all, are contractually-required to have a DEI program from the state/county/city block grant program that administers the funds.

There is an extremely clear and obvious difference in play here–the difference between efficiency and destruction. It’s still stunning, infuriating, and a little heart-breaking that all the top reporters in our legacy media cannot discern that distinction. Look at Elmo! He’s bragging publicly that he’s destroying the government! But legacy media continues in effect to contradict him as they describe his “efforts to increase government efficiency.”
We live in a madhouse.
They hate DEI because you can’t have a Golden Age if discrimination and disparities are documented and addressed. It’s that simple. Make it go away.
Punishing people for following the rules is 100% “on brand” for the patient.
