While I agree with your interpretation of the First Amendment, where I disagree is that I predict the current Republican Supreme Court will disagree. That is if this goes to the Robert’s Court, Trump will win.
But more to the point, this is exactly why Trump was elected president, White grievance.
Which brings up a related question that the media likely knows the answers to but is not providing the information. Of the federal workers losing their jobs thanks to DOGE, what is the racial and gender makeup?
Federal employees are mostly a mirror of the rest of the nation in both ethnic and gender makeup with 75% being White and over 70% of White men and over 50% of White women supporting Trump and Republicans. If Elon Musk is really taking a chainsaw to the Federal workforce most of the those losing their jobs will be White and especially White men who overwhelmingly supported Trump.
The sad part is it probably will not matter as most of them will blame DEI and not Trump for their losing their jobs. But that is another issue.
But anyone who thinks this Republican Supreme Court will rule against Trump for “point of view discrimination” I think has another think coming.

If you’re rich enough, nothing else is required for a whole lot of people to treat you like a god, elevated above all others, it seems. And I don’t remember many news events that have provided such clear and abundant evidence of this really unfortunate fact about human behavior. Hopefully the consequences of this insane carte blanche being handed to Musk will alert at least some regular Americans to the idiocy of this, though it seems unlikely many Republican officeholders or conservative think tankers or the like will wake up any time soon, more’s the pity.

DEI includes a racial element, not exclusively blacks, as we’ve seen. But in Trumpville, even Americans who just look Asian earn their suspicion and vile. DEI also extends to handicaps of all kinds, physical and mental.
The kind of exceptions to “perfect” that can’t be tolerated in a society running optimally.

Reading Josh’s latest ed. about the latest giant DOGE cock-up at the VA. The DOGEys took the most cursory glance at a category of contracts and decided on the spot to cancel them all. In fact they were cancelling contracts for vet burial services, medical services, cancer prevention etc, and the services were largely provided by veteran-owned small businesses. Now DOGE and the VA secretary are backpedaling furiously.
Just in the last month this pattern has unfolded, what, a dozen times. One particular descriptor applies: it’s insanely inefficient! In plain English, DOGE is doing an absolutely crappy and hugely inefficient job. If job is the right word. Clearly their real purpose is to take a chainsaw to government: the damage/inefficiencies garner headlines, and hurt people, and therefore thrill the mouth-breathing Trumpies following on X or Fox.
Any private sector worker tasked with finding and eliminating inefficiencies who worked like these guys would be out the door on his butt in a day. Like a guy who looks at a really busy restaurant and says “Look how many wait staff we have! Fire half of them today.”
Back in the good old days circa 1940, those Nazis also held those exact sentiments. Except these Nazis will freak out if you call them that. They are still trying to look normal, and not like people who are hell bent on destroying their country and causing pain, suffering and death for the least among us. I honestly think this is the optimum time for Trump to resign. His job description is to serve Americans, and he’s not doing that. Do we have to wait for people to die? Probably. He didn’t resign after 800,000 excess deaths on his watch during the pandemic. Instead we get to go through a period of induced chaos, followed by a shift to legal repression. Stalin could “deport” bad-behaving citizens to Siberian stalags, but what is going to happen to our trouble-makers (people who do not believe that the world is over its few centuries of democracy experimentation phase and shifting back to authoritarian mode)?
