My sense from this brief is that Castor is a bit of a slob. Sure, he only had a week, but the fucking lines of arguments probably took no more than 90 minutes and 6 martinis to generate. The Free Speech argument in particular is a non-starter. Trump intended to incite, incited and the audience stormed the capitol. Whether Brandenberg v. Ohio, which defines the standard for non-protected speech to cause imminent incitement, even matters is an issue, as that would apply in his separate criminal trial. In the phone call to Georgia, he threatened, which again is not protected speech.
I’ve always felt that there really is no issue about the defense here. It can be piss-poor, it can be cotton candy, it can be a frozen pizza. 40 Republican senators will still vote to acquit.

It only takes a half hour to get from the Ellipse to the Capitol if you’re crawling with a damaged knee. Otherwise, it’s a 10 minute stroll, 15 if you stop to take a few pics along the way.
