Haven’t read the whole brief, but it looks like they’re sticking to their “45th President of the United States” conceit rather than referring to him as “the former president” and admitting he lost.
In their own words, they can’t have it both ways — if you’re going to argue that he can’t be impeached because he’s no longer president, you have to admit he’s no longer the legitimate president.

Even if The 45th President of the United States directed his supporters to storm the Capitol and murder his enemies, he cannot be guilty of any crime so long as his supporters thought that was a good idea.
