A national Democratic group led by former U.S. Attorney General Eric Holder filed the lawsuit on behalf of voters who argued they were disenfranchised by Walker’s decision not to call elections to fill the vacancies that occurred on Dec. 29.

“Any newly elected representatives would have nothing to vote on,” he (Kilpatrick) said.

While that’s true, the newly elected members could use the time before the next legislative session meeting with their constituents, and figuring out how best to represent them when the session starts.

Republicans no longer even pretend to believe in democracy. They’re getting their asses kicked in PA, KS, and now WI for various forms of disenfranchisement. No doubt Walker’s solution will be to impeach the judge.

The law states elections must be called if they occur before the second Tuesday in May in an election year. Walker argued that only covers vacancies that happen after Jan. 1 of the same year as the election, and since these happened on Dec. 29, 2017, he’s under no requirement to act.

Jesus Christ. This is an utterly ridiculous loophole he is pulling out.

Full disclosure, I think a legislator that pulls this level of intentional malfeasance deserves real world jail time.

So of course, instead of just spending the cost of a special election, they also defend a mindnumbingly stupid legal argument in court that anyone without a law degree should be able to realize could not possibly be defensible. So they end up paying the costs for the special election and the court costs for the lawsuit.

I’m having a pretty good day today. There’s this and then there’s this excerpt from today’s WashPo story on the budget.

"The Education Secretary wanted to spend more than $1 billion promoting vouchers while slashing funding for the rest of her department by $3.6 billion, mostly by taking it from programs that help the poor. She also wanted to make big cuts to the Office for Civil Rights and eliminate grant programs that support student mental-health services.

The final deal basically does the opposite of everything she asked for. Her department’s funding goes up by $3.9 billion, but she gets zero of the dollars she wanted for the school choice program. There’s a $700 million increase in funding for a mental health program that will fund school counselors. There’s $40 million for a D.C. Tuition Assistance Grant that she wanted to eliminate. The Office for Civil Rights, after-school programs and early childhood education programs all get money she said she didn’t want."

Assistant Attorney General Steve Kilpatrick countered that while some voters may be harmed due to the vacancies, the damage does not rise to the legal requirement to force Walker to call special elections.

Yeah…it’s not like our revolution and the principles underlying our form of government had anything to do with people lacking representation.
