So this is OT but there seems to be some confusion over the Deutsch Bank subpoena story (as Josh is alluding to). Anyone know anything? WSJ says yes, but the story has not appeared on WaPo or NYT.

I wonder if the charges were limited to only one count of lying to the FBI, which would seem to me that any pardon would be limited to that count.

Mueller set up his plea deal to address this risk. He only agreed to not prosecute Flynn for the specific lies outlined in the Statement of Offense. Everything else is fair game. A few of those claims, like kidnapping and bribery, can be prosecuted at the state level and therefore out of the reach of Trump.

There is no value to a pardon of Flynn. It would admit Trump had something to hide and would be legally suspect. It would incriminate everyone who participated in the lies and cover up (not that he cares, but Jared is one of them). Flynn would lose his right to self-incrimination and would be forced to spill the beans. No good way for Trump to benefit from a Flynn or Manafort pardon (though legally speaking, Manafort’s charges aren’t specifically tied to the campaign activity). The pardon is a vestige of the absolute/divine right of monarchs. It was limited on purpose for self-interested acts like ‘cases of impeachment’.

Serious question: does anybody ever discuss anything with Donald Trump unless he brings it up? Do they bring him questions, concerns, warnings for what might be coming up in the future? Try to get their yuuuge, classy, golden ducks in a row before getting called to the carpet? When/if they ever do so, they probably do it with Kelly, right? Don’t let the twit-in-chief fuck things up until he absolutely has to?

I actually believe SHS in this case, I don’t think anybody’s intentionally raised the issue with Trump. I think it’s a defense mechanism, nothing more.

Wonder if Flynn, or his son, are susceptible to state charges, especially in New York. A presidential pardon wouldn’t cover those, and the threat might keep him on the reservation.

I suspect there’s a tug of war between the lawyers and sycophants who think der Furor can still beat the rap without admitting wrongdoing, and those who know the ship is sinking and are willing to do anything–because pardoning Flynn would be an admission of guilt–to keep it afloat, if mortally wounded.

It’s almost as if, contrary to the beliefs of the fainting-minnow wing of the online left, Mueller has thought more than zero steps ahead and has gamed out what steps the overall investigative climate could take if he were removed. Something needed? Did she just unintentionally give up the ghost? Clearly, she’s not smart to realize that the time to pardon would be now, before he gives Mueller anymore ammo. “Down the road” isn’t going to help anyone.

I’m not a lawyer, but I think the president could do some kind of broad general pardon if he wanted and was arrogant and crazy enough to do it. It wouldn’t work on state charges though. By charging Flynn on very narrow charges, Mueller has avoided any kind of double indemnity issues and other complications that could arise from a state charging Flynn after the feds charge him. Mueller put some thought and care into the pardon possibility.

Yep. Dotard can pardon Flynn all he wants and it won’t help either of them. Moreover, Mueller already knows everything Flynn knows about Kushner, Uday and Daddy et al.; Flynn had to tell all as part of the plea agreement. And he’d still have to testify regardless.

Trump: I knew Flynn lied. Everyone knew he lied to FBI. Why is that a big deal? He was going to mak $15million tax free and abduct some terrorist in US. Now he has even lost that. Least I can do is pardon him.
