If we are still following the plot line this statement means either tonight or tomorrow I’ll read a transcript of a tape of him jerking off on the phone w/ Stormy and then threatening her when she won’t play along. They are consistently shameful and stupid.

“Your body will be at the bottom of the lake with concrete shoes” is simply a statement of fact, not a threat.

“Threat” is a very subjective word, after all. If they intend to follow through with it regardless, it’s just a “Promise”.

Right? It was a contract requiring three parties. It’s almost like an escrow agreement where only one party and the escrow agent ever sign. The party to whom the bulk of the duties were owed, who explicitly is the owner of all the remedies and from whom the most important consideration was due, claims never to have heard of it but now wants to enforce it.

Cohen’s LLC can have its money back. Whether the contract fails because there was never a meeting of minds, for total failure of consideration by one party, for breach of a material term by Trump’s failure to release her, it ends up the same way–rescission and restitution of consideration given as between Stormy and the Cohen’s front company.

How in the hell anyone actually knows anything about contracts can look at this and say it’s Stormy playing the weak hand is mystifying to me.

The best thing Cohen/Trump have going for them is the arbitration clause and the prospect of some dick-brain half or fully corrupt arbitrator just pulling a result out of his or her ass because reasons. But just on the law? I like her chances.

I will admit I am regularly amazed by how many lawyers I run into who seem to have forgotten almost everything hey knew about contract law ten seconds after their last contracts exam and/or the bar. You see them blundering into basic, embarrassing stuff like asserting unilateral mistake as a defense or failing to spot illusory consideration problems, just all the damn time.
