Inevitably it comes down to “he said/she said”.

Agreed. One item that nobody seems to be paying attention to is that the agreement included a waiver of any and all claims against Clifford by Trump personally. Seems like that is a material part of the consideration that she was to receive. By arguing that Trump knew nothing of the deal and Cohen was just out there freelancing, it strikes me that there was never a contract formed because either there was no meeting of the minds on the deal (regardless of whether Cohen’s fictional company paid some money) or through fraud in the inducement (she thought she was receiving something of benefit that the negotiating party could not deliver). In my view, the politically expedient strategy seems to have created some real long term legal problems for Trump’s team’s efforts to try to enforce the agreement.
