The scum-sucking GOP knew there aren’t enough votes to override the veto, so 12 chicken-shit Senators voted no to give the appearance of being reasonable. Ha! Now that it’s vetoed, there won’t be a Senate override and the GOP wins another cynical battle. Schumer made a huge mistake by praising the 12 Senators for voting no. Now the GOP gets praise AND no override. The Dems need to play this friggin’ game for keeps.

The National Emergency Act simply says that ā€œthe President is authorized to declare such national emergencyā€ without setting any standards, so Barr is correct that Trump’s declaration falls clearly within the letter of the law. Now if one were to look into the intent of the law or were to interpret it with regards to the clear, everyday meaning of the words then Trump is not on very stable ground. Even though he is a stable genius with all the best words.

True enough. But if the president is unable to understand an official action that his handlers attribute to him, it’s not the president who is denied the veto if Congress refuses to accept it. Only the president can veto. His handlers can’t.

Sure, it’s not clear that Trump is categorically unable to understand this veto he supposedly decided on. He’s not in a coma. What would you say about a veto that came out of the ICU room where a president lay in a coma? if you say that the House would have a duty to ignore that pretended act of the president, then you are admitting that ignoring a veto is within the power of the Congress, as long as there is a reasonable presentation that it wasn’t the president who did the veto. It is in fact the duty of Congress to not allow anyone but the president to exercise the veto.

If you are convinced 100% that Trump understood his emergency declaration and his veto sufficiently, then by all means you should not be in favor of ignoring his veto. That would be a usurpation of his powers and duties.

I believe that Trump doesn’t understand his emergency declaration. He showed in announcing it that he doesn’t understand what emergency declarations are for, or the really basic point that Congress and Congress alone can appropriate money. An emergency declaration is a legal workaround, a delegation in law of that appropriations power made for the express purpose of covering situations not foreseen at the time the last annual appropriations were made by Congress. The president has to make the claim that the need for the intended expenditure was not foreseen by Congress, yet Trump admitted the exact opposite, that he had tried to get money for Wall from Congress, but was refused.

Sure, that’s not a slam dunk proof that Trump doesn’t understand this very basic idea. Maybe he understands this basic parameter of his job as well as Obama, and just doesn’t care that he’s breaking the law in his declaration of an emergency that he admits isn’t an unforeseen emergency.

I’m being kind and favorable to Trump in seeing him as demented rather than criminal. My argument is that a criminal would not have admitted that he was committing a crime. The declaration itself could be seen as the act of a criminal, but the announcement proves the absence of criminal intent. Maybe the downgrade from criminal to patient is why you resist the idea that the president is not exempted by anything in the Constitution from the same scrutiny for mental incapacity that all of us live under for all of our actions. You don’t have to believe that it’s 100% certain that Trump is non compos mentis to make him prove that he’s competent, you just have to believe that it’s not entirely clear that he is compos mentis, at least sufficiently competent to discharge the powers and duties.
