“All I’ve asked him for is documents. I don’t know how you can plead the Fifth on a document request,” Burr said, per Politico.
In prior public speeches, Flynn has said that people who plead the Fifth are guilty. I know you won’t ask him about that, but I hope Democrats on the Committee will.
Are documents, or is evidence in general legally considered a form of testimony that you can refuse to turn over documents as part of pleading the fifth?
I’ve never heard of this strategy and it sounds like nonsense. Is this actually an accepted legal strategy?
In normal times, the person ordered to produce would go to court to quash the order. They don’t plead the Fifth.

So if they go to court to quash an order, do they have to give cause? Can they use the right not to self-incriminate?

Maybe Flynn and his lawyers are playing to the alt-press. Something like, “Never in the history of the US has a legitimate request to keep from self-incrimination through turning over documents been denied”.

And what does that mean Contempt of Congress? Does that mean anything? Does that have any penalty? Will they slap him with a wet noodle? What? What will happen?
If it was illegal for Flynn to have the documents, if they directly show he was doing something illegal, or if the government didn’t know they existed, he could go to court and plead the Fifth until the August recess.
But Flynn refusing to go to the Hill in the first place? General, that’s some innovative bullshit. 
If the Intel committee needs to act on a contempt citation on Flynn, they would go to Rod “Won’t Come Clean” Rosenstein at DoJ to take the matter to the nearest Federal district court.
That’s the procedure, which occurs (in the best of times) almost never.
Right? Just when you think you’ve learned to think outside the box, these princes bring it to a whole new level.
It’s all an elaborate dance at this point.
Flynn wants immunity upfront. Without it, he can kiss his pension goodbye.
Burr’s saying start cooperating and then we maybe can talk limited immunity. Maybe.
What would happen after he was declared in contempt?
Would he immediately be taken into custody?
Ay, there’s the rub. In Burr and the GOP we have guys who don’t always do what they guarantee they will do, and in this case they’re saying maybe they’ll take action. Not a pretty picture unless Trump et al shoot themselves in the foot. Again.
Stop for a minute and think how completely unprecedented this is. The chair of a senate committee is talking about whether to move to imprison the president’s former national security advisor in an investigation of possible criminal acts committed before and during the time he was in office. Four months into the presidency, with the president of his own party.
At this point we’re discussing which alternate universe we’re in.
