The job of a prosecutor is to charge and try anyone who an investigation by the police shows them to have committed a crime. The police and prosecutor are responsible for gathering enough legal evidence to convince a jury to return a guilty verdict. The prosecutorâs beliefs should play no role in this process. This particular prosecutor has demonstrated that he believes that police officers are never in violation of any laws, but that should not play any role in his conduct of his office, other than that he needs to recuse himself from any cases where his prejudice is a factor.

âWeâ never indict anyone, unless we have the job of prosecutor. If, by âweâ, you mean as members of a grand jury, we should never even consider the probability of a conviction in making our decision to indict. Our role in a grand jury is to decide whether a crime was committed, and whether there is probable cause to believe that the person being charged did the crime. That is a very, very low hurdle.

It could be a watershed moment. What a way to bookend a presidency too - starting with health care reform passage, and ending with an indictment on LEO killings of civilians.

For whites, the conversation on race is about black behavior, whatever that is. Articulating the long list of infractions committed by blacks, behaviors that whites overlook in themselves, is what whites call the conversation on race.
In stores, for example, the kids having the tantrums or striking their parents or fussing and crying most often are the white kids, but their white parents behave as though this is normal behavior and may respond with a ânow, Justin.â However, if a black child behaves loudly in public, whites immediately indict the entire black race, homing in on bad parenting, fatherless homes, and low-hanging pants.
I sent my daughters to college with this admonition: donât go to frat parties; if you do, donât get drunk around white boys. Most blacks know that white boys are not well raised. Their bad behavior has been written off by their culture as boys-will-be-boys hijinks. Thatâs why the epidemic of rape perpetrated by white boys is being hushed up at campuses around the country.
Yet these observations about whites do not constitute a discussion on race.
A discussion on race focuses on white supremacy and institutionalized racism, which according to polls, white people donât believe exists. Ergo, any conversation about race is pointless.

WE SHOULD NOT BE PITTING COPS AGAINST PEOPLE FOR PETTY STREET-LEVEL CRIMES. For both the safety of the police and the people.
The bottom line is that kids are dying in the street for stupid reasons. Doesnât matter who they are. The police never should have even shook that Michael Brown kid down for such a low level crime. That interaction created a situation in which violence was likely to occur, doesnât matter who was at fault once it got to that point, we shouldnât be subjecting people to those kinds of dangerous situations so often. It is useless to expect free people to behave in the most responsible way all the time, that will never happen. These risky situations happen all the time on a large scale so we need to look at it as a systemic problem.
THE SO-CALLED FREE MARKET CAN SOLVE THE PROBLEMS WE THINK MANY OF THE THINGS WE HAVE CRIMINALIZED ARE CREATING, WE DONâT NEED POLICE TO SOLVE THESE PROBLEMS, THEY ARE AUTHORIZED TO USE VIOLENCE, THAT BEGETS VIOLENCE. IT IS TOO DANGEROUS. WE NEED TO DECRIMINALIZE SOCIETY.
Same problems with this petty theft as with drugs and prostitution. None of it needs to be criminal. We are more than capable of innovating to solve the problems and maintain a safe society. Take the motivation to get violent away by removing the consequences of these actions. Decriminalize and legalize. Maybe certain things are worth policing but these things are not, people will adapt to deal with them.
I will accept what you say, since the American legal system has always mystified me. I had thought that the job of the prosecutor was to pursue justice above a conviction.
