Yes, that’s what gets my goat the most about these people. He will openly and cheerfully admit he thinks laws and rules are for suckers and you should do anything whatsoever you can get away with, but then will use every available legal argument to try and slither his way out of his predicament.

Indeed. I see his problem here. Colluding with America’s enemies to overthrow our democracy for fun and profit is fairly controversial and it makes sense why he’d like to be able to lie about what he did outside the courtroom to better hide the truth that’s revealed in the court. It’s not easy running a GoFundYourself if you can’t embellish the truth a little.

So, Stone’s lawyer’s argument is that defendants should be able to publically trash the government’s case against them as long as they have fewer twitter followers than Kim Kardashian?

It’ll be interesting to see how Judge Berman Jackson reacts to that argument.

As for tainting a prospective jury pool, Stone’s lawyers note that while political junkies may be familiar with him, he boasts far fewer Instagram followers than Kim Kardashian.

So, jury tampering is only possible if the alleged tamperer is the person who the most people pay attention to?

Does this “Kardashian Standard” have any limitations? Does it contemplate dividing audiences into the language(s) they understand, or is it impossible as a matter of logic for any English-speaker to tamper with the jury pool if there’s e.g. a Chinese govt official who has more followers on Twitter than there are speakers of English?

Only a criminal caught dead to rights argues they should be freed on the basis that there is a different criminal who is more successful than they are. Which is probably why so many Trumpers rely on this argument.
