I don’t think the math ends up shaking out that way - 50-50 with a Pence tiebreaker is not practically different from a 50-49 vote. The filibuster language, according to Wikipedia, is “three fifths”, which would require 59.4 = 60 (I assume it’s rounded up) votes.
This just makes me crazy sad.

He asked for an investigation–that’s called due process. That’s more than lardass or Cowboy Roy have asked for. So, why this rush to judgment? If the investigation finds him at fault, he should resign. This makes me ill. The GOP is just pumping this so they can say “but but but Al” when it comes to Cowboy Roy or lardass. We are being had again. Franken resigning will have no effect on Alabama or lardass. None. This means war. Once again, Dems cut off their own feet.
Also, just want to add right here and now, as a NY’er, I have NO intention of voting for Gillibrand ever again. Not going to happen.

I’m no expert in Senatorial minutiae but I think an appointment cannot be made until a seat is actually vacant, i.e. after a resignation is submitted. It’ll be a Democrat almost certainly because the MN governor is a Democrat but it won’t effect the head count of Ds versus Rs.
It makes me crazy mad.
