Not sure the “dissenter” comparison is apt. Bundy grazed his cattle for 20 years without paying the fees, lost all his attempts to get that OKed by the legal system, then once he faced consequences suddenly decided the legal system was illegitimate and yelled for the militia crazies to wave their guns around so the oppressors would go away. He’s not a dissenter, he’s a deadbeat.

I think “scofflaw” is a better term for Bundy than “dissenter.” The obvious difference between the Bundy gang and Occupy is the Bundy gang was armed to the teeth and actually threatened to kill law enforcement.

If Occupy had racked up a bill of over $1 million in fees and not only (a) refused to pay it, but (b) threw down on the feds that came to collect, Dubya and Bloomberg would have called in an air strike.

I’m genuinely curious why this isn’t entirely a law enforcement issues. There are numerous (and famous) examples of people being imprisoned for not paying taxes; seizures of property are commonplace; if a martial threat exceeds police capacity, the National Guard can be brought in. Why haven’t the authorities acted more decisively?

Only civil judgments have been entered against him. And grazing fees aren’t a tax, just a contractual debt. He hasn’t been thrown in jail for the same reason we don’t jail people for not paying their rent. He’s a trespasser and a deadbeat in breach of contract, but he hasn’t been indicted or tried for any crime.

You’re not in civil contempt of court until there’s been a show cause motion and a hearing. A criminal contempt charge gets you all the protections and trappings of any other criminal offense–trial by jury, right to counsel if you can’t afford it.

I could be wrong, but as best I can tell they have thus far not gone that route.

And frankly, they’re behaving exactly the way you want people enforcing laws to behave–not resorting to violence or inflaming situations to the point that violence is a risk in situations not representing life or death or risk of imminent bodily harm. This time, it’s a wingnut. The next time, it could be a bunch of environmentalists or people in the sanctuary movement trespassing on federal land.

(Though, of course, if the land you’re trespassing on in Nevada happens to be in the vicinity of, say, Groom Lake, they’ll purely just blow your ass away.)

The difference between Occupy and the militia gathering around Bundy?

Occupy was an UNARMED movement with a LEGITIMATE message a policy issues.

The MILITIA is an ARMED group of thugs.
