You don’t even have to go that far. According to current law, all able-bodied male citizens between the ages of 17 and 45 are members of the “unorganized militia”:

Militia Act of 1956 (amended 1958)

10 USC § 311 - Militia: composition and classes

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

Whether the “unorganized militia” is “well-regulated” or not is another question, but not one that is likely to attract much attention.

If this was a commonly accepted retort to those hewing to a “strict” interpretation of the militia aspect of the 2nd Amendment language why is it not more universally cited when the issue is argued? Just wondering.

Probably because hardly anyone knows about it. It’s buried in an obscure section of the US Code that probably hasn’t been looked at since it was last amended in 1958. You’d be hard pressed to find any case law referring to this statute.

Besides, this just reaffirms one of the accepted dictionary definitions of “militia”:

OK. So a partially blind, diabetic, morbidly obese, asthmatic, double amputee below the knee with a heart condition couldn’t be in the militia, as he would be ineligible for military service. He’d arguably be worthless, even armed, in any kind of domestic emergency or foreign invasion scenario. Yet he can own a hundred guns.

He probably would’ve been just about as famous/infamous if he would’ve just found some really creative way to kill just himself.

Shoot, he could have just gone out to the backwoods, lived in an abandoned bus, and eaten poisonous plants until he died.

Kind of like the unibomber only he would’ve been more like the univegan.

I was referring to this guy. There are still idiots making pilgrimages out to where he lived and dying or having to get rescued themselves.
