There is no good reason that the question raised needs to be on the 2020 Census. Once again, the “emergency” is an invention of the Trump administration to get its way, when the merits weight against what it wants. The consequences of rushing and putting the question on the census will remain for a decade. Take a little time and make a decent decision.

Yes, the SC is in a bind. This might be their last best chance to tilt the electoral playing field in favor of white people in general, and Republicans in particular.

It will definitely not be their last time, but it is still important that the census not be corrupted by racial politics.

That said, it is really sad and speaks to the lack of legitimacy Republicans have created in every institution of Government to include the Supreme Court, that in light of all we know it is a real possibility that Supreme Court could actually side with Trump.

The SC hyper-conservative ideologues want SOOOOOOO badly to rule that the question remains on the census. They’re salivating at the prospect of turning the USA into an exclusionary haven for right-wing, conservative white people. But, this is so brazenly outrageous that even Roberts is blushing. This must be like putting a raw steak just outside the bars of the lion’s cage.

A fascinating question coming from the Texas judge re the ACA. He says no one has standing to appeal his decision. Could that mean that ALL courts that are higher than his are invalid? That means most Appeals courts and for sure the Supremes. Can’t make this shit up.

I think Roberts must be grinding his teeth down to the gum line on this. The court was played by the Republicans. The new evidence shows the courts were blatantly lied to about the development of the citizenship question. Letting that slide will deeply undermine the position of the courts in government. Courts, as they say, rely on the confidence of the public. If the public sees that courts are not willing to at least fully explore credible claims that they were purposefully lied to for political ends, then any confidence there is will be severely eroded.

Plus, the entire SC already knows full well why the question was added to the census which is about counting people not citizens.

If the Supremes are forced by this move to overturn the question, I fully expect a plan to have ICE hand-deliver all 130 million census forms to each household in America, and demand identity papers at each stop.

Barr: The Court should just decide right now, every issue that might come before it in the next 10 years. Justices appointed by Democratic Presidents do not get a vote.
