The legislation would bar individuals on the No-Fly List and the Selectee list from purchasing guns, but they would be able to appeal the decision under the proposal and have their attorney fees covered if it becomes clear they were wrongly blocked from buying a gun.
So, when your fundamental right to travel is impaired by being put on a watch list, you have no recourse and, indeed, cannot find out why you’re on the list or even whether you’re really on it. But when you’re fundamental right to own a gun is impaired, Due Process out the yin yang. Yeah. Makes sense.

Those GOP Senators up for election can be confident that their party brethren in the House will prevent any Senate-passed legislation from going any further. Nice to have a backstop for showboat votes.
Realistically, you cannot just have free rein here where every potential proposal is put up for a vote – you need to schedule things given time restraints etc. It shouldn’t be only up to one person, but some rules need to be in place.

Yup, the GOP had no major concerns with the current due-process-free no-fly list, as they probably figure that the vast majority of the people put on that list are Muslims – especially scary middle easterners and inscrutable Asian types --and other brownish and/or foreign-talkin’ ignorables.
They could easily overlook the fact that some small number of “real Americans” might be caught up on that list and run into problems when trying to travel, but once you add the red-meat-to-the-base gun issue in there, suddenly the idea that even that small number of “real Americans” might face gun-related hassles due to the no-fly list, suddenly they’re all civil libertarians, deeply concerned about the use of secret evidence, lack of due process, and so on. So it goes.

I’m not for letting them off the hook on this - they need to be forced to close the gun show and private sale loophole AND expand background checks too.

The No Fly List, the Selectee List and the Terror Watchlist all started under Pres. Bush. So where was the outrage over innocent Americans ending up on the list then Sen. Graham, I’ve been in Congress since 2003.
Here are the only questions regarding this bill that matter:
Will passing this bill cost any U.S. gun manufacturer even one cent in lost sales?
Will passing this bill cost any sitting Republican member of Congress their seat?
If the answer to either question is yes, then the nays will prevail.
